Acceptance of these Terms and Conditions
- These terms and conditions apply to any goods and services supplied, or to be soon supplied by Cross Country 4×4 to the customer and or any third party on the customers behalf.
- The Customer has been expected to have read and understood and agreed these terms and conditions. If at any time the Customer has had services supplied to them from Cross Country 4×4.
- Cross Country 4×4 reserve the right to amend these terms and conditions at anytime at its discretion. Any other order by a customer constitutes acceptance of the changes Cross Country 4×4 has made.

- Our Products have a 12-month warranty against manufacturing faults from third party companies.
- Lifetime warranty on Cross Country 4×4’s workmanship.
- All Products and goods that have been shipped by Cross Country 4×4 are subject to our returns policy, this includes a restocking fee of 15% and a cancelation fee of 15%.
- No Returns after 30 days of the product being delivered to customers chosen postal address.
- You must have permission from us to return any goods.
- Freight costs on return to Cross Country 4×4 are the customers responsibility.
- Goods to be returned in original packing and saleable condition or the customer is void of the refund
Pricing and Orders of our goods and services
Pricing/Quoting
- Price of our goods and services are to be Cross Country 4×4’s quoted price,
- Cross Country 4×4 reserves the right to change our products and services prices without prior notice if no quote has been received and agreed upon between Cross Country 4×4 and the customer.
- All prices are in AUD (Australian Dollars) and will be on everything quoted.
- Cross Country 4×4, at its sole discretion, may issue a quote to the Customer following a request by the customer for goods and services.
- Cross Country 4×4 reserves the right to cancel or modify a quote at any time before the customer has accepted the quote.
- Quotes may only be accepted by a customer in their entirety.
- A quote is valid for the time stated in the quote, or if no time period is specified, then 30 days from the date of issue.
Orders
- By placing an order for goods through the website, the customer makes an offer to purchase the good for a specified price at the time the customer places the order. Cross Country 4×4 may at its own discretion accept or reject any offer made by the customer for any reason.
- All instructions and drawings provided by Cross Country 4×4 in a descriptive matter, that are contained on the website or as a drawing, and or hard copy instructions are
- published for the sole purpose of giving an approximate idea of how the goods are intended to be used/ fitted. Unless explicitly included in a quote or otherwise agreed upon in writing by Cross Country 4×4, they will not form part of an order.
- Accepted quotes will be considered orders following acceptance by the customer and payment and or a payment of a deposit.
Cancellation of orders
- if an order for goods is cancelled before the goods are dispatched, Cross Country 4×4 reserves the right, at its absolute discretion, to invoice the customer for any expenses incurred by Cross Country 4×4 up to the time of cancellation and up to 72-hours afterwards, including but not limited to, materials, wages, equipment hire and licences.
- Orders may not be cancelled after goods are dispatched or services are provided.
- The customer will receive a 15% cancelation fee on refund of purchase from Cross Country 4×4
Payment
- Cross Country 4×4 will invoice the customer and the customer must pay the amount due on the invoice in accordance with the payment terms set out.
- Subject to any special terms agreed to in writing between Cross Country 4×4 and the customer, Cross Country 4×4 is entitled to invoice the customer for the price of goods and services before time of delivery.
- If goods and services are to be done by Cross Country 4×4 inhouse whether it is fitment, mechanical work, inhouse fabrication and dynamometer work, payment is required by the customer to Cross Country 4×4 before the customer can pick up their vehicle.
- Payment must be made in full before any dispatch of intercoolers or parts that have been ordered.
- If the customer and Cross Country 4×4 have agreed to the customer to have a trading account, then the account must be paid within 30 days from the end of the previous trading month.
- Discounts of any type, apply to applicable items only. For a customer to receive any discount.
Services
- Services at Cross Country 4×4, where Cross Country 4×4 is required to perform services with respect to a customer’s vehicle while at Cross Country 4×4’s premises,
- Unless otherwise agreed upon, the customer is responsible for delivering and collecting their vehicle from Cross Country 4×4’s premises.
- Cross Country 4×4 may exercise a possessory lien over the customers vehicle until amounts owing are paid in full.
– In some circumstances, it may be necessary for Cross Country 4×4 to remove parts from the Customer’s Vehicle (Removed Parts) to carry out the fitment of replacement parts and accessories. |

– The Customer acknowledges and agrees that the Removed Parts are in most situations unavoidably destroyed and unsuitable for re-use. Cross Country 4×4 will dispose of the Removed Parts unless the Customer advises otherwise. |

– If the Customer wishes to retain the Removed Parts, they must inform Cross Country 4×4 before the commencement of the Services. If so, the Customer must collect the Removed Parts on the day that the Customer’s Vehicle is collected. The Customer is solely responsible for loading and transport, and acknowledges that due to their condition, the Removed Parts may not be able to be moved inside the Customer’s Vehicle. |
Shipping of goods
- Any delivery times advised by Cross Country 4×4 to the customer are only estimates, and Cross Country 4×4 is not liable to the customer or any other parties for late delivery or non-delivery.
- Cross Country 4×4 is not liable for damage to goods during transit to the customers chosen postal address.
- Cross Country 4×4 will not relieve the customer of their obligations to accept and pay for the goods if there is a delay in delivery or dispatch.
Ownership of goods
- The legal and equitable titles to the goods will not pass until the customer has paid all monies owed to Cross Country 4×4 on any account whatsoever, payment shall not be taken to occur until cleared funds are showing in Cross Country 4×4’s bank account.
- Cross Country 4×4 reserves the right to enter upon any premises for the purpose of repossessing the goods and without prejudice to any other rights of recovery.
- Until the buyer has paid all monies owing to Cross Country 4×4 on any account whatsoever, the relationship of the customer to Cross Country 4×4 shall be fiduciary in respect or non-delivery.
- Owning a Cross Country intercooler requires that the customer is expected to fit and install the Intercooler and parts that come with it, as it is intended in our instructions and failure to do so and breaking or damaging the intercooler in the process will exclude the customer from our warranty.
Cancellations and returns.
- No order may be cancelled by the customer except with the consent in writing of Cross Country 4×4 and one of our representatives, and on the condition that the customer will indemnify Cross Country 4×4 against any losses resulting from the cancellation.
- Special made to order goods and parts cannot be returned for credit or refund.
- If agreed upon with Cross Country 4×4 parts and goods can be returned.
- The Customer must obtain authorisation first from Cross Country 4×4 to return goods.
- The Customer is liable for the costs of returning goods and any costs incurred of returning goods to Cross Country 4×4.
- All returns and or warranty will be inspected by an authorised personnel of Cross Country 4×4 before any warranty or refunds can accepted.
- Cross Country 4×4 reserves the right to make a handling and restocking fee of 15% on all goods returned. If goods are under the 30 day warranty no returning fee will apply.
Unforeseeable events
- In the event that Cross Country 4×4 is prevented from carrying out our obligations under a contract for sale as a result of any cause beyond its control, such as but not limited to, acts of God, terrorism, war, strikes, lockouts, natural disasters. Failure of third parties to not deliver goods, the Customer will be relived if their obligations and liabilities under such contract for sale as long as such fulfilment its prevented.
Buyer Default
- If the buyer makes default in any payment, commits any act of bankruptcy or enters into liquidation whether voluntary or involuntary, Cross Country 4×4 may at its discretion suspend deliveries or cancel any contracts so far as it remains unperformed without prejudice to its rights there under.
Use of intellectual property
The Customer must not, without Cross Country 4×4’s written consent
- Sell, sublicense, rent, lease, lend, modify, alter, translate, reproduce, transmit, distribute, publicly display, publicly perform, publish, adapt, or edit any part of the work IP.
- Combine or incorporate the work IP in any aspect of the customers business without Cross Country 4×4’s written permission.
- The use of any logo and or use of “Cross Country 4×4” is not authorized for anyone but Cross Country 4×4.
- Copy the work IP in whole or in part, except to incorporate the work IP into hard or soft copy documents for training or internal communication purposes.
- Use the work IP in anyway which is not in accordance with the specifications of these terms.
- Use the work IP for any unlawful purposes.
- Authorise any other party to do any of the acts listed above.
General
- A new contract shall in all respects be constructed and operate as an Australian contract, and in conformity with Australian law.
- If any part of these terms and conditions that is not fundamental is found to be illegal or unenforceable, such finding will not affect the validity or enforceability of the remainder of these terms and conditions.
Warranty Information
- Our Products have a 12-month warranty against manufacturing faults from third party companies.
- Limited Lifetime warranty on Cross Country 4×4’s workmanship.
- All our intercoolers come with a limited lifetime warranty for the original purchaser, with 12-month warranty on parts that are not manufactured by Cross Country 4×4 Pty Ltd, which includes the core, silicones, clamps, fans, and wiring loom. Fitment instructions must be followed for warranty to be applicable in all circumstances, any variation from the fitment instructions will void warranty.
- Lifetime limited warranty is defined that the warranty is for the products that Cross Country 4×4 has fabricated and is deemed a part of the lifetime warranty, which includes, all aluminium tank welding, welded tanks onto the intercooler core, welded pipes/hard pipe kits and pipe work from the intercooler.
- All fabrication that is done by Cross country 4×4 can hold the limited lifetime warranty, including but not limited to, stainless steel snorkels, air box pipes all aluminium work and steel welding fabricated by Cross Country 4×4.
- All warranty is held only by the original purchasers of our products.
Cross Country 4×4 warranty procedure
- Cross Country 4×4 must be contacted for approval prior to sending back goods for warranty.
- All warranty or return goods must be returned with all transportation costs prepaid and the customers contact details clearly identified on the returned product.
You will be required to give Cross Country 4×4 the following information.
- Details of the date the product was purchased and from whom.
- The product purchased.
- The nature of concern.
- Cross Country 4×4 will contact you for further information if required and assess the claim.
Marketing and media
- Cross Country 4×4 make take photographs or record video of the customers vehicle before, during and after providing services, or obtain such media through social media, website, or email (media).
- Cross Country 4×4 may use the media to promote its goods and services through social media, press releases, competitions, and other forms of self-promotion. When engaging in such promotional activities, the customer acknowledges and agrees that Cross Country 4×4 disclose the relationship between the parties and the nature of the goods and services provided and use and publish any part of the media as it sees fit.
- The Customer may opt out of media being used for promotional activities by contacting Cross Country 4×4 in writing.
Privacy
- The customer hereby authorizes Cross Country 4×4 to collect, retain, record use and disclose commercial and consumer information about the customer, in accordance with privacy law, to persons and/or legal entities, including a solicitor or any other professional consultant engaged by Cross Country 4×4, a debt collector, credit reporting agency and/ or any other individual organisation which maintains credit references and/or default settings.
- We only collect personal information that is necessary to deliver our services. Cross Country 4×4 collects personal information about you when you request our services that could be used to provide you with our products. Information is collected via online contact forms, on the phone or in person.
- Cross Country 4×4 will not sell, transfer, assign or rent your personal information.
- Cross Country 4×4 will not collect your personal information without your consent.
- Cross Country 4×4 will endeavour to take all reasonable steps to keep secure information.
- In addition, our employees and data processors are obliged to respect the confidentially of any personal information held by us.
- However Cross country 4×4 will not be held responsible for events arising from unauthorised access to your personal information.
